This document includes information governing appropriate behavior when using Tayza's suite of websites, applications, and services (the "Service"). Questions, comments and concerns regarding the Terms or Service should be sent to admin@tayza.io.
These Terms of Service (the "Terms") are a binding agreement between the user and Tayza, Inc. The user must accept all Terms in order to have the right to use the Service. Use of the Service in any capacity implies that the User has agreed to the Terms, and the Terms will remain in effect while the Service is being used by the User. The Terms serve as an extension of Tayza's Privacy Policy, and as such acceptance of these Terms includes acceptance of both the below document and the Privacy Policy.
Tayza's Delivery Service allows for users to create local-area delivery requests for their packages. These requests are processed by a dispatcher and distributed to a Courier network that will retrieve and deliver the user's package on a same-day basis. Once a delivery request is made, Tayza provides evidence of postage in the form of a label and retrievable status information for any given delivery. Tayza's Delivery Service is accessible through the Tayza Client Portal, Tayza Shoplink Shopify App, or through a custom integration with the Deliver API.
In order to use the Service, the user is required to have a Tayza account. Currently, accounts are manually issued to clients and cannot be created without contacting Tayza's Sales team. To log in to the Client Portal, the user requires a valid email and password. The user may not use an email address that they do not have the right to use, and accounts may not be transferred to anyone else without prior written consent from Tayza. To use the Deliver API, the user must retrieve their API key from the Client Portal. The user may make this key public, either purposefully or through an act of neglect.
The user represents and warrants that they are of legal age to form a binding contract (or if not, they have received permission from a legal guardian to agree to the Terms on their behalf). if the user accepts the Terms on behalf of an organization or entity, they represent and warrant that they are authorized to agree to these Terms on behalf of the organization or entity and bind them to the Terms.
The user will use the Service solely for internal, personal, use and not on behalf of or for the benefit of any third party unless given explicit, written consent from Tayza Inc., and only in a manner which complies with all laws that apply to the user. The user will ensure that all information supplied to the Service in connection to requesting deliveries is complete and accurate. If the user's use of the Service is prohibited by applicable laws, they are not authorized to use the Service. Tayza can not and will not be responsible for service use that breaks the law.
The user will not share their account credentials(account email, password) with any party, and the user is obligated to protect the security of this information. The user is responsible for any and all activity associated with their account.
You represent, warrant, and agree that you will not use the Service in a manner that:
(a) Infringes or violates the intellectual property rights or other rights of anyone else (Including Tayza);
(b) Violates any law or regulation;
(c)Is harmful, fraudulent, deceptive, threatening, harassing, defamatory, obscene, or otherwise objectionable;
(d) Jeopardizes the security of your account or that of any other user's;
(e) Attempts, in any manner, to obtain the password, account, or other credentials from any other user;
(f) Violates the security of any computer network, or cracks any passwords or security encryption codes;
(g) Runs any form of automated spam on the Service, or that otherwise interfere with the proper behavior of the Service (including by placing an unreasonable load on the Service's technical infrastructure);
(h) "Crawls," "Scrapes," or "Spiders" any page, data, or portion of or relating to the Service or content, (through use of manual or automated means);
(i) Copies or stores any significant portion of the Content that is not directly associated with your own account;
(j) Decompiles, reverse-engineers, or otherwise attempts to obtain the source code or underlying structure or information of or relating to the Service;
A violation of any of the foregoing is grounds for immediate termination of your right to use or access the Service.
The subject matter of Tayza's Terms of Service may be subject to change as Tayza evolves its suite of services. Tayza reserves the right to alter the Terms at any time. If alterations made materially impact the Terms, all users will be alerted to changes through messages on the Tayza website and/or through email.
The user is free to reject the new Terms, but in so doing will no longer have access to the Service. use of the Service after any changes to the Terms have been posted implies agreement to the new Terms.
Except for changes by Tayza as described here, no other amendment or modification of these terms will be effective unless in writing and signed by both parties.
